Article 104 - Registration of Collective Investment Funds
(1) TheRegulatory Authority may makeRules relating to the registration by it ofCollective Investment Funds .(2)Rules made by theRegulatory Authority under Article 104(1) may provide that all or certain categories ofCollective Investment Fund may not be established or promoted in or from theQFC unless they have been registered.(3)Rules made by theRegulatory Authority under Article 104(1) may also include provisions as to:(A) the constitution, management and operation of suchCollective Investment Funds ;(B) the investment and borrowing powers of suchCollective Investment Funds ;(C) the procedure forApplication to theRegulatory Authority for registration ofCollective Investment Funds ;(D) operating duties and responsibilities in respect ofCollective Investment Funds ;(E) the registration of offering material or particulars and reporting requirements forCollective Investment Funds ; and(F) suspension of dealings in and termination ofCollective Investment Funds .Article 105 - Power to Make Directions in respect of Collective Investment Funds
(1) TheRegulatory Authority may give a direction under this Article if it appears to theRegulatory Authority that:(A) in respect of aCollective Investment Fund registered under Article 104(1), one or more of the requirements underRules made pursuant to Article 104(1) is no longer satisfied or is likely to be breached; or(B) it is desirable to give such a direction in order to protect the interests of holders of Units or potential holders of Units in a registeredCollective Investment Fund .(2) A direction under this Article may:(A) (in the case of aCollective Investment Fund established in theQFC ) require thePerson orPersons responsible for the management or operation of a registeredCollective Investment Scheme :(i) to cease the issue or redemption of both the issue and redemption of Units in theCollective Investment Fund ; or(ii) to wind up theCollective Investment Fund ;(B) (in the case of anyCollective Investment Fund registered under Article 104(1)) withdraw theRegulatory Authority's registration of thatCollective Investment Fund ; or(C) restrict or suspend promotion or sale of Units in aCollective Investment Fund .(3) Any direction pursuant to this Article may be referred to theAppeals Body by thePerson orPersons referred to in Article 105(2)(A) or by the affectedCollective Investment Fund .
